1. Acceptance of Terms

By creating an account and using Bulko (the "Service"), you agree to abide by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Description of the Service

Bulko is a platform for cold email outreach. The service provides:

• Creation and management of email campaigns
• AI content rotation and subject generation
• Managing subscriber lists
• Campaign analytics (open/click/reply tracking)
• Email validation (SPF, MX, blacklist, deliverability)
• Collection and AI classification of incoming replies

3. User Account

3.1 Registration

To use the Service, you must create an account with accurate information. You are responsible for keeping your credentials secure.

3.2 Responsibilities

• You must be at least 18 years old
• You are responsible for all actions taken under your account
• If you detect unauthorized access — notify us immediately
• One person or organization may have only one account

4. Acceptable Use

It is prohibited to use the Service for:

• Spam mailings to recipients who have not explicitly consented and have no legitimate business interest
• Violating applicable laws and third-party rights
• Transmitting malicious, offensive, or illegal content
• Impersonating another person or organization
• Disrupting the Service or attempting unauthorized access
• Phishing, malware distribution, brand impersonation, fraud
• Collecting email addresses without permission (harvesting)

4.1 Automatic Content Moderation (AI Filter)

Provide correct sender information

• Emails classified as PHISHING, MALWARE, or SCAM are automatically rejected before sending (the SMTP relay returns 554 5.7.1)
• A snapshot of the blocked email (subject, body fragment, number of recipients, sender, reason) is stored for investigation for up to 12 months
• Repeated blocks may result in immediate suspension or termination of the account without refund
• Email credits are not deducted for blocked messages; however, credits already purchased are non-refundable even if subsequent emails are blocked
• By using the Service, you agree to this automatic content processing for abuse prevention purposes

5. Compliance with Email Laws

You must comply with applicable email marketing laws:

• CAN-SPAM Act (USA)
• GDPR (European Union)
• CASL (Canada)
• The "On Advertising" and "On Personal Data" laws (Russia)
• Other applicable anti-spam regulations based on recipient location

You must:

• Have a legal basis for sending (recipient consent or legitimate interest for B2B outreach)
• Provide accurate sender information
• Provide an unsubscribe link
• Timely processing of unsubscribe requests (Bulko does this automatically via a global suppression-list)

6. Pricing and Payment

6.1 Pay-as-you-go

Bulko operates on a pay-as-you-go model: you purchase email and AI credits via one-time payments through selected packages or a flexible quantity. There are no subscriptions or automatic charges.

6.2 Payment Terms

• All payments are processed through third-party gateways (Stripe, CoinGate, Heleket, CactusPay) — Bulko does not store card details.
• Prices may change with 30 days' notice; credits already purchased are not recalculated
• Credits don't expire — they stay on your balance until used
• Incomplete payments result in a temporary sending restriction until the transaction is confirmed

7.1 Our Property

The Service, including all content, functionality, and code, belongs to Bulko and is protected by copyright, trademarks, and other intellectual property laws.

7.2 Your Content

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that harm the Service or other users. Upon account termination, your right to use the Service will immediately cease.

8. Data and Privacy

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Postigo operates, without regard to its conflict of law provisions.

9. Limitations and Modifications of the Service

• We reserve the right to modify or discontinue the Service at any time
• We do not guarantee uninterrupted, error-free operation
• Usage is limited by your SMTP account limits and the number of paid credits
• We may introduce additional technical restrictions to prevent abuse

You agree to indemnify and hold Bulko harmless from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

The email will be sent without open-tracking for maximum deliverability.

Until final entity details are published, the parties will attempt to resolve claims through written notice to [email protected]. Governing law and the competent court will be specified after registration of the Bulko operator; this interim wording does not limit mandatory consumer rights where applicable.
